Before the national courts

  • Vincent BERGER provides advice regarding the advisability of commencing or continuing proceedings before the national courts on the basis of the Convention and the case law of the ECtHR.
  • If necessary, he prepares written submissions and takes part in hearings.

Before the ECtHR

  • He gives legal opinions - in writing or orally - on the procedure and practice of the ECtHR and even more on the chances of success of any application to the ECtHR. He does so in light of the Strasbourg case law, especially the case law regarding the strict admissibility requirements of the Convention.
  • He writes applications to the ECtHR and observations before it (comments concerning Governments' observations and claims for just satisfaction), requests and observations of third party intervention, as well as requests for interim measures.

Before the Human Rights Committee

  • Furthermore he lodges communications before the United Nations Human Rights Committee, based on the International Covenant on Civil and Political Rights. He participates in the proceedings until its completion, by filing observations on admissibility and merits and claims for compensation.
